Trump Admin Refunds $100 Billion in Tariffs Struck Down by Supreme Court

The Trump administration is refunding approximately $100 billion in "Liberation Day" tariffs to businesses following a landmark Supreme Court decision earlier this year. The Supreme Court ruled in February 2026 that President Donald Trump exceeded his authority by imposing these tariffs under the International Emergency Economic Powers Act (IEEPA), asserting that the power to levy taxes, including tariffs, rests with Congress.

The invalidated tariffs, which were part of a broader trade policy, had generated around $166 billion in revenue from US importers. As of late July 2026, the US Customs and Border Protection (CBP) confirmed it had processed about $100 billion in refunds, with this amount certified and sent to the Treasury Department for disbursement. This extensive refund process has required CBP to implement a new system to manage the high volume of declarations.

While a significant portion of the tariffs has been deemed unlawful, other industry-specific tariffs imposed under different legal authorities remain in effect. The Trump administration has also continued to introduce new tariff measures under various legal frameworks, some of which are already facing fresh legal challenges.
